We will do our best to make every cake and dessert to your satisfaction.
However, since our items are freshly made to order and highly customized, we do not offer unconditional returns or exchanges except in some cases. Please refer to the following terms and conditions:
Please inspect your order upon reception and contact us immediately if the item is defective, or damaged or if you receive the wrong item so that we can evaluate the issue and make it right.
All the sales of cakes, desserts, and customized cakes are FINAL and NONREFUNDABLE once processed.
All items are non-returnable unless you have received the wrong cake or dessert. In that case, you have the option of an exchange or refund. However, you must return the incorrectly delivered cake.
The product pictures are of the actual products we make, but due to display differences and the water-soluble nature of fresh cream, improper storage, as well as over time, can lead to changes in color. The color of the final product may slight vary from the pictures. Therefore, we are unable to issue refunds or replacements for disputes over color differences. Thank you for your understanding.
For standard products, you may request a change or cancellation 3 business days prior to your chosen pick-up/delivery date. Due to the production process and preparation needs, we are unable to provide requests for changes or cancellations within 3 business days, even if all our cakes are made on the same day.
For custom cakes and any event cakes, the dessert table requires at least 15 days notice of the change. Any change requests made within 15 days will not be honored. Orders cannot be canceled for custom cakes.
If you have to cancel your order, we will provide a store credit refund. If you need a refund to the original payment method, we will deduct 5% of the card processing fee charged by the payment processing agency.

1.1 These Terms and Conditions govern the use of services provided by The Place Toronto ("the Company", "we", "us", "our"), including but not limited to the purchase of custom-made cakes and related confectionery products (collectively, the "Services").
1.2 By accessing or using our Services—whether online, in-person, or through third-party platforms—you agree to be bound by these Terms and Conditions. If you do not agree, you must discontinue use of our Services immediately.
1.3 We reserve the right to revise these Terms and Conditions at any time. Continued use of the Services following updates signifies your acceptance of the revised terms.
2.1 The Company offers made-to-order cakes and confections either produced in-house or via third-party partners. Engaging our Services implies agreement with the terms herein.
2.2 Pricing is subject to change without notice. We reserve the right to correct any pricing errors and to discontinue products or services at our discretion.
2.3 Full payment is required at the time of order unless otherwise expressly agreed in writing.
3.1 All sales are final. Due to the perishable and customized nature of our products, orders cannot be cancelled, modified, returned, or refunded after confirmation and payment.
3.2 Orders must be placed within the specified lead time for each product. Late or last-minute orders may be rejected or subject to additional charges.
3.3 Alterations to orders must be submitted in writing and are subject to approval and additional fees.
3.4 Refused orders will not be refunded under any circumstances. If a customer chooses not to accept delivery or pickup, the order is considered fulfilled.
4.1 Our kitchen and partner facilities handle common allergens including nuts, gluten, eggs, dairy, and soy. Despite our best efforts, cross-contamination may occur.
4.2 Customers must disclose any allergies or dietary restrictions when placing orders. The Company is not liable for allergic reactions caused by consumption of our products.
5.1 Orders placed online must contain accurate and complete information. The customer is responsible for all details provided.
5.2 If account creation is required, customers are responsible for maintaining the confidentiality of their credentials and for all activities under their account.
6.1 Delivery services are available within specific zones as outlined on our website. It is the customer’s responsibility to provide accurate and complete delivery information.
6.2 We do not guarantee delivery times. While we strive to meet requested delivery windows, delays caused by traffic, weather, or third-party partners are outside our control and do not constitute grounds for cancellation or refund.
6.3 Delivery is attempted once only. If the recipient is unavailable or the delivery address is incorrect, the product will be returned to our facility and must be picked up within 24 hours. No redelivery will be arranged and no refund will be issued.
6.4 For deliveries to apartments or condos, cakes will be delivered to the building lobby or entrance only. Entry is not guaranteed.
6.5 Orders marked for pickup must be collected during the designated pickup window. Unclaimed pickups are considered fulfilled and are not eligible for refund.
7.1 While we aim for accuracy, our website and communications may contain typographical errors or omissions related to product information, pricing, or availability.
7.2 We reserve the right to correct errors and to cancel or refuse orders that contain incorrect pricing or product descriptions.
8.1 To the maximum extent permitted by law, the Company and its affiliates are not liable for any direct, indirect, incidental, or consequential damages arising from the use of our Services.
8.2 Customers agree to indemnify and hold harmless the Company and its affiliates from any claims or liabilities arising from their use of the Services, violation of these terms, or breach of any applicable laws.
9.1 These Terms are governed by the laws of Ontario, Canada. Disputes shall be resolved in the courts of Ontario, Canada.
